In exchange for participation in the activities of workshops and studio usage (the “Activity” or “Activities”) organized by Vesper Design LLC (“Vesper Design" or the "Company"), located at 16089 San Dieguito Rd, Suite H201, Rancho Santa Fe, California, 92067, and/or for the use of the property, facilities, and services of Vesper Design LLC, I ("Participant") agree, for myself and (if applicable) for the members of my family, to the following:

Assumption of the Risks and Release

I recognize that there are certain inherent risks associated with the above-described Activities, and I assume full responsibility for any personal injury to myself and (if applicable) my family members. I further release and discharge Vesper Design LLC and their agents for any injury, loss, or damage arising out of my or my family's use of or presence upon the facilities of Vesper Design LLC, whether caused by the fault of myself, my family, Vesper Design LLC, or other third parties.

Agreement To Follow Instruction

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Vesper Design LLC, or the employees, representatives, or agents of Vesper Design LLC.

Participants agree to the following conditions when participating in Vesper Designs' workshops and studio.

General Disclosures and Terms

Hazardous Material Disclosure

Participants acknowledge that the Activity may involve the use of potentially hazardous tools and materials, including but not limited to: scissors, utility knives, heat guns, hot wax, aerosol sprays, air-dry clay, and other crafting materials. Participants assume all risk associated with their use and agree to follow all safety instructions provided by the Studio.

Photography consent

I consent to myself, any minors under my charge participating in the Activities, and/or my property, being photographed by Vesper Design LLC as part of the workshops and studios. I understand that Vesper Design LLC will hold full ownership of the resulting photographs as their author, and will use them according to the following conditions below:

• To sell art prints

• To post online and on social media

• For marketing purposes

Consent For Minors

I, [Parent/Guardian Name] of [Address], [City], [State] [Zip Code] consent to the participation of my [Minor Relationship], [Minor Name], in the activity of workshops and studio use, and agree on behalf of the above minor to all of the terms and conditions of this agreement. By signing this Release of Liability, I represent that I have legal authority over and custody of [Minor Name].

 I, as Parent/Guardian, with legal responsibility for this Participant, have read and explained the provisions in this Agreement to my child/ward including the risks of presence and participation in the Activity and his/her personal responsibilities for adhering to the rules and regulations for protection. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for Vesper Design LLC and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless Vesper Design LLC for any and all liabilities incident to my child's/ward's presence or participation in the Activity as provided above, even if arising from the company's own negligence, to the fullest extent provided by law.

I have read this participant waiver and release form, fully understand the risks it describes and agree to its terms, and sign it freely and voluntarily.
