This Statement of Privacy applies to www.vesperdesign.co, the mobile application Vesper Design, and Vesper Design LLC This statement of Privacy governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Vesper Design include www.vesperdesign.co, the mobile application Vesper Design, and Vesper Design LLC Vesper Design is an ecommerce website and mobile application. By using the Vesper Design website and/or application, you consent to the data practices described in this statement.

 

Collection of your Personal Information

 

In order to better provide you with products and services offered, Vesper Design may collect

personally identifiable information, such as your:

• E-mail Address

 

We do not collect any personal information about you unless you voluntarily provide it to us.

Vesper Design does not sell, rent, or lease customer information to third parties.

 

Vesper Design may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. Vesper Design may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. Information Collected Automatically. When you use the Services, we automatically collect the following information about you:

 

• Usage data. We automatically record your behavior on our Site, including the pages you visit and the actions you perform. In addition, we record the URL from which you arrived at our websites.

• Identifiers and device information. When you visit our Site, our servers automatically collect certain technical information about your devices, such as your Internet protocol address and information about your devices, such as device identifiers (such as MAC address), your browser type, language and identifying information, your operating system and application version, device types, device model and manufacturer, and your device operating system type and version. Retention of Information

We retain information for as long as necessary to offer the requested Services, comply with our legal requirements, resolve disputes, enforce our agreements, and for other legitimate and lawful business objectives. California Privacy Rights

Right to Know. You are permitted to seek the following information from businesses:

Note that the CCPA broadly defines "business purpose,"; and because we use service providers for a variety of business purposes that require access to our systems that hold personal information (such as providing cloud data storage, maintaining the security of our systems, and providing customer support), we have disclosed for a business purpose data from each of the categories of personal information we maintain in the past 12 months.

• The categories of your personal information that we have sold (if any) to each category of third parties to whom we have sold your personal information. Note that the CCPA defines "sell" and "personal information" in a very broad manner, and some of the data sharing mentioned in this Notification may be considered "selling" under that meaning. Specifically, we allow advertising and analytics providers to gather IP addresses, cookie IDs, and mobile IDs via our websites and applications when you use our online services, but we do not "sell" other forms of personal information. Our "Do Not Sell My Information" disclosures are included in the section of this Notice titled "Cookies and Similar Technologies."

Right to Opt-Out. You may opt-out of future "sales" of your personal information. To do so, please visit the "Do Not Sell My Information" portion of this Notice's Cookies and Similar Technologies section.

 

In writing or through a power of attorney, you may appoint an authorized agent to execute your rights under the CCPA on your behalf. Before accepting such a request from an agent, we will ask the agent to show evidence that you have authorized it to act on your behalf. In addition, you may be required to authenticate your identity with us directly. In addition, in order to disclose or remove certain pieces of personal information, we will need to confirm your identification with the level of certainty required by law. You have the right not to be discriminated against for exercising CCPA-guaranteed rights.

 

In addition, California Civil Code section 1798.83, also known as the "Shine the Light" law, permits California residents who have provided personal information to a business with which the individual has established a business relationship for personal, family, or household purposes ("California Customers") to request information about whether the business has disclosed personal information to third parties for the third parties direct marketing purposes. Customers from California may email gabiamon@vesperdesign.co to obtain additional details regarding our compliance with this law. Businesses must only reply to one request per California customer every calendar year. They may not be required to respond to requests received through any other means than the stated email address.

 

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

 

•     Delete your personal information from our records; and

•     Direct any service providers to delete your personal information from their records.

 

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

 

•     Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

•     Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

•     Debug to identify and repair errors that impair existing intended functionality;

•     Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

•     Comply with the California Electronic Communications Privacy Act;

•     Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

•     Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

•     Comply with an existing legal obligation; or

•     Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

 

Children Under Thirteen

Vesper Design collects personally identifiable information from children under the age of thirteen. Vesper Design collects this information for the following reason(s):

 

• To register the accounts of subscribed users.

• To send marketing emails to subscribed users.

Cookie Controls

E-mail Communications

From time to time, Vesper Design may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from Vesper Design or click on a link therein.

 

If you would like to stop receiving marketing or promotional communications via email from Vesper Design, you may unsubscribe from emails by selecting the unsubscribe option at the bottom of each marketing or promotional email.

 

Changes to this Statement

Vesper Design reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating any privacy information.
